JS Visuals (“we”, “our” or “us”) is a photography, video and media company based in Sydney, NSW, Australia. We photograph, film and edit property media for agents, agencies and property owners, cover functions and events, and also offer website development & design, e-commerce store builds, SEO and portraits.
This Privacy Policy explains what personal information we collect, how we use and share it, how we keep it secure, and how you can access or correct it or make a complaint. We are committed to handling personal information in a way that is consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Where consent is required, we will ask for it rather than treat this policy as blanket consent.
01Information We Collect
We collect only what we need to book, shoot, edit and deliver your media and to run our business. Depending on how you work with us, that may include:
- Contact and booking details — your name, agency, email address, phone number, and what you tell us when you enquire, send the contact form, call or book a shoot.
- Property addresses and access details — the address of the property, access instructions, key or lockbox details, the contact details of an occupant or vendor where you give them to us, and preferred shoot times.
- Agency and branding details — your agency name, logos, brand colours and marketing requirements, so we can tailor delivered media to suit your agency’s branding.
- Images and footage — the photographs, video, drone footage, floor plan measurements and other media we capture at the property, and any images, files or content you supply to us for editing, virtual staging, photo decluttering, website or SEO work.
- Payment details — the billing and payment information needed to issue invoices, take payment and keep accurate records.
- Website usage data — pages visited, device and browser type, approximate location derived from your IP address, and how you arrived at our website.
02How We Use Information
We use personal information as reasonably necessary to:
- Shoot, edit, produce and deliver the media and services you book, including photography, twilight, drone, video, floor plans, virtual staging, decluttering, websites, SEO and portraits.
- Communicate with you about bookings, access, scheduling, delivery, revisions and enquiries.
- Issue invoices, process payment and keep business records.
- Improve our services, workflow, customer service and website.
- Let you know about our services and offers, where you would reasonably expect us to. You can opt out of marketing messages at any time by emailing us.
- Comply with our legal obligations and protect our legal rights.
03Property Images and People
Our work is photographing and filming properties, not people. Where a person, vehicle, number plate, family photograph or other personal item incidentally appears in an image or footage, we may edit it out on request. Please tell us before the shoot or as soon as you review the delivered media.
If you book a shoot of an occupied property, please let the occupants know that a shoot is taking place and what it will involve.
Agent portraits and headshots are taken with the consent of the person photographed and are supplied to that person or their agency for the purpose agreed at booking.
04Drone Footage
Drone photography and video are subject to Australian aviation regulations and to conditions on the day. Aerial images may incidentally include neighbouring properties, streets and public areas.
We use drone footage only for the purposes described in this policy. Where an aerial image includes incidental detail you would prefer not to show, we may crop or edit it on reasonable request.
06Marketing Use of Images
We are proud of our work. From time to time we may ask to showcase completed work in our portfolio or on Instagram at @jsvisuals.au. We will only do so with your agreement, and you can withdraw that agreement at any time by emailing hello@jsvisuals.com.au.
We do not publish access details, occupant details or anything that is not already part of the public marketing of the property. If you withdraw your agreement, we will remove the media from our channels within a reasonable time.
07Storage and Security
We store personal information and media digitally and take reasonable administrative, technical and physical steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure. Access is limited to the people who need it to do their work. No method of storage or transmission over the internet is completely secure, and we cannot guarantee absolute security.
We keep information for as long as it is needed for the purpose it was collected, to service future bookings, and to meet our legal and accounting obligations. After that we take reasonable steps to delete or de-identify it. If you would like media from a completed booking removed from our systems, email us and we will action it within a reasonable time, subject to any records we are required to keep.
If we become aware of a data breach that is likely to result in serious harm, we will investigate and notify affected people and the Office of the Australian Information Commissioner where required by law.
08Access, Correction and Complaints
You may ask to access or correct the personal information we hold about you. Contact us using the details below and we will respond within a reasonable time. We may take reasonable steps to verify your identity before completing a request.
If you believe we have mishandled your personal information or breached the Australian Privacy Principles, please contact us first. We will investigate and respond within a reasonable time. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at www.oaic.gov.au.
10Changes to this Privacy Policy
We may update this Privacy Policy as our services or legal requirements change. We will post the updated version on our website and revise the “Last updated” date. This policy should be read together with our Terms & Conditions.
